Miller & Martin attorney Nick Whittenburg has been elected by the Mid-South Commercial Law Institute to serve as Board Member.
For more than 30 years, Mid-South Commercial Law Institute has conducted annual CLE seminars on commercial and bankruptcy law, held in Nashville, Tennessee. The seminar panel includes leading scholars, jurists, and practitioners, and the content is authoritative, comprehensive and timely, and the breadth of topics covered includes bankruptcy, insolvency and restructuring, creditors’ rights, finance, and commercial litigation.
Whittenburg joined the firm as an associate in 1990. He became a partner with the firm in 1996. In 2001, he became Assistant General Counsel with AmSouth Bank (now Regions Bank) where he directed the defense of all commercial and consumer litigation against AmSouth. Whittenburg rejoined Miller & Martin as a Member in 2004 and he is currently a member of the firm’s Bankruptcy and Creditors’ Rights Practice Group.
The focus of Whittenburg’s practice is the representation of a variety of creditors and stakeholders in commercial bankruptcy related litigation before the Bankruptcy Courts across the United States, including New York, Delaware, Virginia, Texas, Georgia and Tennessee. He regularly represents business clients, financial institutions, commercial property management companies, manufacturers, landlords and municipal and cooperative utilities respecting Chapter 11 cases filed throughout the country, For example, he has represented regional and super-regional banks and insurance companies to preserve and protect their collateral in bankruptcy and workouts. He has also represented a variety of manufacturers, including a multi-national Coca-Cola bottler, to prosecute administrative claims, to defend preference suits and in connection with unsecured creditors’ committee participation. He has represented commercial landlords, franchisors, licensors and utilities to protect and assert their rights under leases and contracts in connection with attempts by debtors to assume, reject or assign leases and contracts. Whittenburg has represented many municipal and cooperative utilities operating throughout the Southeast in a variety of bankruptcy related matters, including the defense of preference suits and to secure adequate assurance of performance from bankrupt commercial customers. Finally, he has successfully represented stalking horse bidders and equity investors to secure Bankruptcy Court approval of the acquisition of assets out of bankruptcy.
