Barristers, Beer and Bar-B-Q to benefit Backpack Project

The Young Lawyers Divi-sion of the Chattanooga Bar Association is throwing its hat into the ring of local charitable efforts with Barristers, Beer and Bar-B-Q, a fundraiser for the group’s Backpack Project and
the local chapter of Court Appointed Special Advocates. The affair is scheduled to take place Nov. 18 at Museum Bluffs Parkview condominiums, located by Walnut Street Bridge, beginning at 5:30 p.m.

The waiting area for the emergency department at Memorial Hospital is almost filled to capacity with people needing help. While doctors, physicians assistants and nurses are already attending to the patients needing urgent care, everyone there has a reason to believe the ER is where they need to be, and each person has brought a unique medical issue for the staff to resolve.

Federal Insurance Company, A/S/O Robert and Joanie Emerson v. Martin Edward Winters, D/B/A Winters Roofing Company.
Hamilton County – Plaintiff insurer of insured brought this action as a subrogee of the insureds, who had been paid under plaintiff’s policy for a fire loss to their home. The insureds had employed a roofer to replace their roof, whose subcontractor caused the fire which destroyed the home. Plaintiff brought this action to recover from defendant roofer who filed a Motion for Summary Judgment and the trial court ruled defendant could not be held liable in tort for the negligent acts of his subcontractor under the facts of this case, and plaintiff could not recover under the theory of contract, because plaintiff could not show that the loss was caused by the contractual services or foreseeable. On appeal, we hold that summary judgment was inappropriate, because under contract law the defendant had a non-delegable duty to see that the work he was contractually obligated to perform was done in a careful, skillful and workmanlike manner. The case is remanded with instructions to proceed in accordance with this Opinion.

Trick or treat
Halloween was pretty much a non-event at our house this year. I think we just had six or seven groups of the little sugar-worshippers who climbed the steep stairs to our front door, to get to the Snickers and M&Ms, which I picked out Saturday morning at Kroger while buying ingredients for chili.

At Merlin Mann’s “43 Folders” Web site, I found a little anecdote that the host thought was apropos of writer’s block:
It seems that, during the filming of “Marathon Man,” Dustin Hoffman showed up one day looking like death warmed over, to borrow a phrase. Beyond his appearance, he was clearly exhausted, to the point of being and practically delirious.

The Tivoli Theatre was packed all the way to the very last row of the upper balcony when the classic rock band, Styx, came back to Chattanooga for a powerful performance.
I first saw Styx at Riverbend when I was 16 years old, and was mildly impressed in my teenage way with their sound. Having had a few years of musical experience since then, I was absolutely floored by the Styx performance at the Tivoli.

Swiss Chard. Funny name. Is it a chard plant derived from the Switzerland? Well, my younger sister called me with a recipe this weekend using Swiss Chard, so that is what I have for you today, but first, I gotta find out about that name!
Once I started my search, I found two different stories on the origin (of course!), so I’m not sure which one is correct - or if either one of them is real. Actually, I think one is trying to say what the other one says, it’s just not as clear.
